Zone81: English resources and information for gaijin in Japan

Top court rejects foreigners' appeal over fingerprints

Thursday, June 27 2002, 09:30

TOKYO - In response to a law suit by nine gaijin in Japan saying fingerprinting all foreigners in Japan is unconstitutional, The Supreme Court's No. 1 petty bench Thursday ruled it to be constitutional and threw out the suit.

Judge Kazutomo Ijima said it is indeed constitutional according to precedent.

So while you fingerprint me and open my mail for me, why don't you just put us all on parole so you can check what mischief those "nasty foreigners" are up to? If all Japanese had to be fingerprinted despite never commiting a crime they would have a fit. I guess we can call this a "petty ruling" from the "petty court."

What is a petty court anyway? (If you know, don't tell me. It means you are a lawyer and I don't want to talk to you anyway.) Whatever it is it sure has a dumb name.

I am from Melbourne Australia and we get a few Japanese students and people on work permits there. I tell them about the fingerprinting issue of foriegners in Japan and they just dont believe it. They think I am lying! If we, Australians, did this to foriegners our courts would be jammed up with litigators for decades!

I was in the Japanese Consulate here in Melbourne Australia the other day with my 7 year old daughter. A middle aged Japanese man, who has always been giving me filthy looks over the past few years, asked the Japanese counter staff (in Japanese) "Is he allowed to be here?" referring to me. The staff member answered "Of course he is well known to us he has a Japanese wife and four daughters, he is a well known businessman here" This man kept on referring to me as a "Gaijin" in the country WHERE I WAS BORN! Needless to say I chewed him out (in fluent Japanese) and told him to get out of MY country if he is going to bring his petty attitude problem here. (Australia). He seemed not to enjoy the experience.
